Kelly Santini Successfully Defends Contractual Interpretation of Co-Tenancy Agreement Registered on Title of Townhouse Community
Kelly Santini’s Eric Appotive and Allison Russell successfully defended an appeal to the Ontario Court of Appeal in Furr v. Duhamel, 2019 ONCA 824. The Appellant was seeking to overturn the Judge’s decision in Furr v. Duhamel, 2018 ONSC 1780 with respect to the interpretation of a registered co-tenancy agreement governing the rights and financial obligations of all homeowners in a prestigious Ottawa townhouse development. The Court of Appeal agreed that the Judge correctly applied the legal principles governing contractual interpretation and the appeal was dismissed. Eric and Allison represented the Committee responsible for overseeing the operations of the townhouse development and its elected members.
