Kelly Santini’s Samantha Iturregui was successful in her motion for summary judgment dismissal of a professional negligence claim brought against an insurance brokerage. When a fire destroyed the property, the insurer denied coverage as the property had sat vacant  beyond the 30 day exclusion period. The Court agreed that the plaintiff had a duty to advise their broker, Crain & Schooley Insurance Brokers Ltd., of a material change in risk after their rental property was vacated and left empty for several years.    Click to read the full judgment in Elevli v.
