Kelly Santini Secures Exclusion of Prejudiced Expert Reports

In the case of Simmermon v. Djoudad et al., Kelly Santini’s Danesh Rana successfully assisted his clients in getting the court to strike opposing expert reports from the record. The court ruled that the evidence presented by the opposing expert was highly prejudicial, as the expert had been granted access to communications that were protected by settlement privilege. Consequently, the court declared the expert’s evidence “tainted” and eliminated both the reports and the cross-examination testimony of the opposing expert. Additionally, the court noted that this was one of the rare instances where it was justified to file a motion to strike the evidence of an expert before the main application hearing. This measure ensured that the judge at the main hearing would only consider admissible evidence.
